Krenuo sam s djevojkom u šumu u Gornjoj Šumetlici oko podneva. I zaboravio sam da u ruksaku imam malu staklenu teglicu sa klobucima i stručcima gljiva (psilocin i psilocibin op.a). U njoj je bilo 0,19 grama gljiva koje su mi ostale od prije mjesec dana kad sam s djevojkom također bio u šumi i brao gljive. Iskreno, nisam znao da su one na popisu droga i da su zabranjene. Tog smo dana zaustavljeni na brdu. To su bile dvije gljive. Količinski nije toga bilo puno i nisam ih konzumirao - branio se u sudnici "gljivar" Alen S. kojeg je zagrebački prekršajni sudac odlučio novčano kazniti.

Naloženo mu je plaćanje 400 eura novčane kazne jer je neovlašteno posjedovao gljive koje se nalaze na popisu droga, psihotropnih tvari i biljaka. Ogriješio se time o članak 3. st.1. Zakona o suzbijanju zlouporabe droga, a bez gljiva je trajno ostao te su iste postale vlasništvo MUP-a koje ih, pak, mora uništiti. Također mora platiti i 99 eura sudskih troškova u što je uračunato vještačenje gljiva.

- Okolnost da se radilo o manjoj količini i da nije konzumirao gljive ne ispričava okrivljenog od odgovornosti za ovo djelo. Postupao je sa svjesnim nehajem lakomisleno smatrajući, iako svjestan da može počiniti prekršaj, da se to neće dogoditi. Kao olakotnu okolnost sud je cijenio priznanje prekršaja i da je podstanar, dok mu je otegotna njegova prekršajna kažnjavanost - obrazložio je presudu prekršajni sudac, prenosi Jutarnji.hr.

Krenuo sam s djevojkom u šumu u Gornjoj Šumetlici oko podneva. I zaboravio sam da u ruksaku imam malu staklenu teglicu sa klobucima i stručcima gljiva (psilocin i psilocibin op.a). U njoj je bilo 0,19 grama gljiva koje su mi ostale od prije mjesec dana kad sam s djevojkom također bio u šumi i brao gljive. Iskreno, nisam znao da su one na popisu droga i da su zabranjene. Tog smo dana zaustavljeni na brdu. To su bile dvije gljive. Količinski nije toga bilo puno i nisam ih konzumirao - branio se u sudnici "gljivar" Alen S. kojeg je zagrebački prekršajni sudac odlučio novčano kazniti.

Naloženo mu je plaćanje 400 eura novčane kazne jer je neovlašteno posjedovao gljive koje se nalaze na popisu droga, psihotropnih tvari i biljaka. Ogriješio se time o članak 3. st.1. Zakona o suzbijanju zlouporabe droga, a bez gljiva je trajno ostao te su iste postale vlasništvo MUP-a koje ih, pak, mora uništiti. Također mora platiti i 99 eura sudskih troškova u što je uračunato vještačenje gljiva.

- Okolnost da se radilo o manjoj količini i da nije konzumirao gljive ne ispričava okrivljenog od odgovornosti za ovo djelo. Postupao je sa svjesnim nehajem lakomisleno smatrajući, iako svjestan da može počiniti prekršaj, da se to neće dogoditi. Kao olakotnu okolnost sud je cijenio priznanje prekršaja i da je podstanar, dok mu je otegotna njegova prekršajna kažnjavanost - obrazložio je presudu prekršajni sudac, prenosi Jutarnji.hr.
