Četiri navijača Hajduka koji su pušteni iz istražnog zatvora u kojem su završili zbog sumnje da su sudjelovali u napadu na policiju na odmorištu Desinec, na autocesti između Zagreba i Karlovca, imali su sreću što se jedan od njih javio svojoj - majci.

Naime, videosnimka koju joj je poslao pokazala je da su se nalazili na udaljenosti od nekoliko stotina metara od sukoba huligana i policajaca. Također je majci poslao glasovnu poruku u kojoj je kazao: “U koloni smo. Naši su napravili šou na pumpi s bengalkama, raketama. Tučnjava je s policijom. Policija puca iz pištolja. Znači horor”.

Njih četvorica zajedno su u istom osobnom automobilu došli sa šireg šibenskog područja gdje žive, tako da su snimke bile spasonosne za sve. Na zvučnoj poruci se također moglo čuti da je snimljena u tišem okruženju, u kojem nema buke, povika i pucnjeva, specifičnih za nered te večeri.

Nakon takvog razvoja događaja Općinsko državno odvjetništvo u Velikoj Gorici je tražilo obustavu postupka i puštanje iz istražnog zatvora za: Antonija Š. (24), Lovru M. (19), Stipu L. (21) i Ivana M. (29) zbog nedostatka dokaza.

Odvjetnik Neven Gotal, koji zastupa 21-godišnjeg Stipu L. iz Vodica, potvrdio nam je da su videosnimku, koja traje točno tri sekunde, poslali državnom odvjetništvu, ali i da je sigurno nađen u mobitelu prilikom pregleda dokazne materije.

Sve je bilo jasno

- Mislim da je videosnimka bila ključna, svi od kojih se odustalo su iz istog automobila. Oni su dokazali svoju nevinost jer se na videosnimci vidi da su neredi u tijeku, a da su oni udaljeni nekoliko stotina metara. Meni je moj klijent kazao da su gledali nered, a nakon dolaska policije su se brzo vratili u vozilo, kada su izvučeni i uhićeni.

Policija je, pretpostavljam, vidjela da netko žurno ulazi u auto i reagirala na taj način. Ne krivim policiju jer sam svjestan da nisu mogli odmah razaznati tko je kriv, a tko nije.

Činjenica je da je, s obzirom na to koliko materijala ima, DORH brzo utvrdio da su moj klijent i njegovi suputnici nevini. Bio je u istražnom zatvoru 17 dana i tražit ćemo naknadu štete za taj period - najavio nam je odvjetnik.

Njegovom klijentu je ovo bilo prvo gostovanje, a inače je zaposlen i neće imati problema s povratkom na posao. Preostalih 38 uhićenika čeka daljnji tijek istražnog postupka u kojem su osumnjičeni da su zajednički i dogovorno isplanirali napad i izazivanje nereda.

U sukobu s policijom te subote navečer ozlijeđeno je 20 policajaca i 15 osumnjičenika, od kojih su četiri ranjena vatrenim oružjem. Prema prvim informacijama, sve prostrijelne rane su od metaka koji su se odbijali od tla. Oštećena su i četiri službena vozila.

Kako saznajemo, svi oduzeti mobiteli su pregledani, a u tijeku su biološka i DKT vještačenja, tj. traže se otisci prstiju i pokušavaju se izdvojit DNK profili. Tragovi su uzeti s vatrogasnih aparata, prometnih znakova, boca, pojasa i ostalih predmeta kojima su nasrtali i koje su bacali na policiju.

Jedan od policajaca je dobio bocu direktno u lice, neposredno kraj oka. Intenzivno se pregledavaju i sve videosnimke nadzornih kamera s benzinske postaje i s autoceste.

Prigovori odvjetnika

Nad uhićenima je određen istražni zatvor do mjesec dana, a potvrdilo ga je izvanraspravno vijeće Županijskog suda u Velikoj Gorici, koje je odbacilo žalbe jednog dijela uhićenih. Za ostale se još uvijek čeka odluka po žalbama.

Osnova za zadržavanje u istražnom zatvoru je mogućnost ponavljanja kaznenog djela. Odvjetnici uhićenih osporavaju navedenu pritvorsku osnovu jer je veliki dio njih neosuđivan, ali su sud i DORH drukčijeg mišljenja.

Smatraju da prijašnja osuđivanost nije jedini temelj za zadržavanje zbog mogućnosti ponavljanja kaznenog djela. Procijenili su da je dovoljna osnova opis iz inkriminacije “izazivanja nereda sudjelovanjem u mnoštvu”, što je posebna okolnost.

Pogotovo kada se uzme u obzir da su tijekom napada na 16 policajaca od brojčano nadmoćnih nasilnika bili ugroženi i ostali građani te imovina većeg opsega.Taj dio im se stavlja na teret zbog aktiviranja pirotehničkih sredstava na benzinskoj postaji.

Četiri navijača Hajduka koji su pušteni iz istražnog zatvora u kojem su završili zbog sumnje da su sudjelovali u napadu na policiju na odmorištu Desinec, na autocesti između Zagreba i Karlovca, imali su sreću što se jedan od njih javio svojoj - majci.

Naime, videosnimka koju joj je poslao pokazala je da su se nalazili na udaljenosti od nekoliko stotina metara od sukoba huligana i policajaca. Također je majci poslao glasovnu poruku u kojoj je kazao: “U koloni smo. Naši su napravili šou na pumpi s bengalkama, raketama. Tučnjava je s policijom. Policija puca iz pištolja. Znači horor”.

Njih četvorica zajedno su u istom osobnom automobilu došli sa šireg šibenskog područja gdje žive, tako da su snimke bile spasonosne za sve. Na zvučnoj poruci se također moglo čuti da je snimljena u tišem okruženju, u kojem nema buke, povika i pucnjeva, specifičnih za nered te večeri.

Nakon takvog razvoja događaja Općinsko državno odvjetništvo u Velikoj Gorici je tražilo obustavu postupka i puštanje iz istražnog zatvora za: Antonija Š. (24), Lovru M. (19), Stipu L. (21) i Ivana M. (29) zbog nedostatka dokaza.

Odvjetnik Neven Gotal, koji zastupa 21-godišnjeg Stipu L. iz Vodica, potvrdio nam je da su videosnimku, koja traje točno tri sekunde, poslali državnom odvjetništvu, ali i da je sigurno nađen u mobitelu prilikom pregleda dokazne materije.

Sve je bilo jasno

- Mislim da je videosnimka bila ključna, svi od kojih se odustalo su iz istog automobila. Oni su dokazali svoju nevinost jer se na videosnimci vidi da su neredi u tijeku, a da su oni udaljeni nekoliko stotina metara. Meni je moj klijent kazao da su gledali nered, a nakon dolaska policije su se brzo vratili u vozilo, kada su izvučeni i uhićeni.

Policija je, pretpostavljam, vidjela da netko žurno ulazi u auto i reagirala na taj način. Ne krivim policiju jer sam svjestan da nisu mogli odmah razaznati tko je kriv, a tko nije.

Činjenica je da je, s obzirom na to koliko materijala ima, DORH brzo utvrdio da su moj klijent i njegovi suputnici nevini. Bio je u istražnom zatvoru 17 dana i tražit ćemo naknadu štete za taj period - najavio nam je odvjetnik.

Njegovom klijentu je ovo bilo prvo gostovanje, a inače je zaposlen i neće imati problema s povratkom na posao. Preostalih 38 uhićenika čeka daljnji tijek istražnog postupka u kojem su osumnjičeni da su zajednički i dogovorno isplanirali napad i izazivanje nereda.

U sukobu s policijom te subote navečer ozlijeđeno je 20 policajaca i 15 osumnjičenika, od kojih su četiri ranjena vatrenim oružjem. Prema prvim informacijama, sve prostrijelne rane su od metaka koji su se odbijali od tla. Oštećena su i četiri službena vozila.

Kako saznajemo, svi oduzeti mobiteli su pregledani, a u tijeku su biološka i DKT vještačenja, tj. traže se otisci prstiju i pokušavaju se izdvojit DNK profili. Tragovi su uzeti s vatrogasnih aparata, prometnih znakova, boca, pojasa i ostalih predmeta kojima su nasrtali i koje su bacali na policiju.

Jedan od policajaca je dobio bocu direktno u lice, neposredno kraj oka. Intenzivno se pregledavaju i sve videosnimke nadzornih kamera s benzinske postaje i s autoceste.

Prigovori odvjetnika

Nad uhićenima je određen istražni zatvor do mjesec dana, a potvrdilo ga je izvanraspravno vijeće Županijskog suda u Velikoj Gorici, koje je odbacilo žalbe jednog dijela uhićenih. Za ostale se još uvijek čeka odluka po žalbama.

Osnova za zadržavanje u istražnom zatvoru je mogućnost ponavljanja kaznenog djela. Odvjetnici uhićenih osporavaju navedenu pritvorsku osnovu jer je veliki dio njih neosuđivan, ali su sud i DORH drukčijeg mišljenja.

Smatraju da prijašnja osuđivanost nije jedini temelj za zadržavanje zbog mogućnosti ponavljanja kaznenog djela. Procijenili su da je dovoljna osnova opis iz inkriminacije “izazivanja nereda sudjelovanjem u mnoštvu”, što je posebna okolnost.

Pogotovo kada se uzme u obzir da su tijekom napada na 16 policajaca od brojčano nadmoćnih nasilnika bili ugroženi i ostali građani te imovina većeg opsega.Taj dio im se stavlja na teret zbog aktiviranja pirotehničkih sredstava na benzinskoj postaji.
