Nad Brodosplitom je otvoren predstečajni postupak u kojemu bi se trebali razriješiti dosadašnji dužnički odnosi i koji bi mogao završiti nagodbom, prihvate li vjerovnici dužnikov plan oporavka.

Razlog je - nelikvidnost splitskih brodograditelja. Kažu da "zbog više sile, rata u Ukrajini i sankcija uvedenih Rusiji" nisu mogli realizirati prethodno odobrene kredite.

Prijedlog za pokretanje predstečajnog postupka zatražio je Tomislav Debeljak, čija je DIV Grupa vlasnik brodogradilišta, a što je – iz drugog Brodosplitova pokušaja – u petak popodne prihvatio Trgovački sud.

Ne treba zaboraviti ni da je koncem travnja zagrebački Trgovački sud otvorio predstelajni postupak nad DIVom, također na Debeljakov prijedlog.

"Otvara se predstečajni postupak nad dužnikom BRODOGRAĐEVNA INDUSTRIJA SPLIT d.d. (skraćena tvrtka BRODOSPLIT d.d.). Za povjerenika se imenuje Mateo Puljić. Pozivaju se vjerovnici dužnika da nadležnoj jedinici Financijske agencije, u roku od 21 dana od dana dostave ovog rješenja, prijave svoje tražbine na propisanom obrascu."

Napisao je tako u rješenju sudac Ivan Čulić.

Naložio je povjereniku Puljiću da o svemu obavijestiti poznate strane vjerovnike splitskog dužnika i da ih upozna sa svim bitnim informacijama o postupku.

Posrnuli Brodosplit i njegov sudski povjerenik trebaju "Fini, u roku od 30 dana dostaviti tablice prijavljenih tražbina, pisano očitovanja o svakoj prijavljenoj tražbini, na način da se izjasni priznaje li je ili osporava, uz obveznu naznaku iznosa za koji se tražbina osporava i razlog osporavanja."

Sudac u rješenju navodi i niz uputa vjerovnicima, kojima je dužnik dužan omogućiti uvid u isprave iz kojih proizlaze tražbine navedene u Brodosplitovu popisu imovine i obveza.

A dužnikovi dužnici, znači, oni koji nešto duguju Brodosplitu, pozvani su da svoje dospjele obveze ispunjavaju bez odgode.

Sudsko ročište na kojem će se ispitivati tražbine Brodosplitovih vjerovnika održat će se 7. rujna na Trgovačkom sudu u Splitu.

U obrazloženju rješenja, sudac ističe da je brodogradilište predložilo pokretanje postupka zbog prijeteće nesposobnosti za plaćanje. Podsjetimo, prema škverskim navodima, radilo se o oko 44 milijuna kuna nepodmirenih računa, početkom svibnja. Brodosplit je tada bio u blokadi tri tjedna.

Svakako treba reći i da je popis ukupnih Brodosplitovih obveza upisanih u poslovne knjige dosegnuo milijardu kuna. No Debeljak u prijedlogu niže argumente navodne uspješnosti u škveru: 560 milijuna kuna zadržane stare dobiti, kao i 1,7 milijardi kuna kapitala i rezervi, 2,27 milijardi kuna imovine i 156 milijuna kuna dobiti u 2020. godini.

Sudac je ocijenio da je škverski prijedlog za pokretanje predstečaja osnovan.

Treba naglasiti da Brodosplit još nije dostavio plan restrukturiranja tvrtke, ali to može učiniti najkasnije 21 dan od pravomoćnosti rješenja o utvrđenim i osporenim tražbinama, odnosno od dana dostave odluke drugostupanjskog suda o žalbi protiv rješenja o utvrđenim i osporenim tražbinama.

Nad Brodosplitom je otvoren predstečajni postupak u kojemu bi se trebali razriješiti dosadašnji dužnički odnosi i koji bi mogao završiti nagodbom, prihvate li vjerovnici dužnikov plan oporavka.

Razlog je - nelikvidnost splitskih brodograditelja. Kažu da "zbog više sile, rata u Ukrajini i sankcija uvedenih Rusiji" nisu mogli realizirati prethodno odobrene kredite.

Prijedlog za pokretanje predstečajnog postupka zatražio je Tomislav Debeljak, čija je DIV Grupa vlasnik brodogradilišta, a što je – iz drugog Brodosplitova pokušaja – u petak popodne prihvatio Trgovački sud.

Ne treba zaboraviti ni da je koncem travnja zagrebački Trgovački sud otvorio predstelajni postupak nad DIVom, također na Debeljakov prijedlog.

"Otvara se predstečajni postupak nad dužnikom BRODOGRAĐEVNA INDUSTRIJA SPLIT d.d. (skraćena tvrtka BRODOSPLIT d.d.). Za povjerenika se imenuje Mateo Puljić. Pozivaju se vjerovnici dužnika da nadležnoj jedinici Financijske agencije, u roku od 21 dana od dana dostave ovog rješenja, prijave svoje tražbine na propisanom obrascu."

Napisao je tako u rješenju sudac Ivan Čulić.

Naložio je povjereniku Puljiću da o svemu obavijestiti poznate strane vjerovnike splitskog dužnika i da ih upozna sa svim bitnim informacijama o postupku.

Posrnuli Brodosplit i njegov sudski povjerenik trebaju "Fini, u roku od 30 dana dostaviti tablice prijavljenih tražbina, pisano očitovanja o svakoj prijavljenoj tražbini, na način da se izjasni priznaje li je ili osporava, uz obveznu naznaku iznosa za koji se tražbina osporava i razlog osporavanja."

Sudac u rješenju navodi i niz uputa vjerovnicima, kojima je dužnik dužan omogućiti uvid u isprave iz kojih proizlaze tražbine navedene u Brodosplitovu popisu imovine i obveza.

A dužnikovi dužnici, znači, oni koji nešto duguju Brodosplitu, pozvani su da svoje dospjele obveze ispunjavaju bez odgode.

Sudsko ročište na kojem će se ispitivati tražbine Brodosplitovih vjerovnika održat će se 7. rujna na Trgovačkom sudu u Splitu.

U obrazloženju rješenja, sudac ističe da je brodogradilište predložilo pokretanje postupka zbog prijeteće nesposobnosti za plaćanje. Podsjetimo, prema škverskim navodima, radilo se o oko 44 milijuna kuna nepodmirenih računa, početkom svibnja. Brodosplit je tada bio u blokadi tri tjedna.

Svakako treba reći i da je popis ukupnih Brodosplitovih obveza upisanih u poslovne knjige dosegnuo milijardu kuna. No Debeljak u prijedlogu niže argumente navodne uspješnosti u škveru: 560 milijuna kuna zadržane stare dobiti, kao i 1,7 milijardi kuna kapitala i rezervi, 2,27 milijardi kuna imovine i 156 milijuna kuna dobiti u 2020. godini.

Sudac je ocijenio da je škverski prijedlog za pokretanje predstečaja osnovan.

Treba naglasiti da Brodosplit još nije dostavio plan restrukturiranja tvrtke, ali to može učiniti najkasnije 21 dan od pravomoćnosti rješenja o utvrđenim i osporenim tražbinama, odnosno od dana dostave odluke drugostupanjskog suda o žalbi protiv rješenja o utvrđenim i osporenim tražbinama.

Trgovački sud prihvatio Debeljakov zahtjev: Brodosplit u predstečaju zbog nelikvidnosti, Mateo Puljić imenovan povjerenikom

Nad Brodosplitom je otvoren predstečajni postupak u kojemu bi se trebali razriješiti dosadašnji dužnički odnosi i koji bi mogao završiti nagodbom, prihvate li vjerovnici dužnikov plan oporavka.

Razlog je - nelikvidnost splitskih brodograditelja. Kažu da "zbog više sile, rata u Ukrajini i sankcija uvedenih Rusiji" nisu mogli realizirati prethodno odobrene kredite.

Prijedlog za pokretanje predstečajnog postupka zatražio je Tomislav Debeljak, čija je DIV Grupa vlasnik brodogradilišta, a što je – iz drugog Brodosplitova pokušaja – u petak popodne prihvatio Trgovački sud.

Ne treba zaboraviti ni da je koncem travnja zagrebački Trgovački sud otvorio predstelajni postupak nad DIVom, također na Debeljakov prijedlog.
