Zadarski odvjetnik Davor Buljan (72), bivši vlasnik licencije "Formule 2000", koji je koncem rujna 2003. godine u Zadru organizirao prvu utrku morskih bolida zahvaljujući prijateljstvu s Tuliom Abatteom, svjetskim imenom u proizvodnji superbrzih čamaca, pravomoćno je osuđen za prevaru vlasnika hotela 'President' gdje je ostao dužan 137.914 kuna za banket nakon održanog mitinga.

Čak osamnaest godina od kada je ostao dužan vlasniku zadarskog hotela Zdravku Barbaroši, Županijski sud u Zadru potvrdio je presudu nižeg suda koji ga je za kazneno djelo prevare osudio na uvjetnu kaznu od godine dana s rokom kušnje od tri godine.

Iako je potvrdio kaznu, Županijski sud u Zadru je ukinuo dio presude u kojem se Buljanu nalaže da u roku od šest mjeseci Barbaroši isplati dug od 137.914,50 kuna, ili će se uvjetna osuda opozvati.

Zadarski odvjetnik je te 2003. kao predsjednik udruge moto-nautičkog kluba “Formula 2000” i organizator svjetskog prvenstva u utrci motornih čamaca s Barbarošom dogovorio smještaj natjecatelja i njihovu prehranu. Nakon što je dogovora nije podmirio račun od 137 tisuća kuna koje je trebao podmiriti Visa i American karticama. Vlasnik tada jedinog zadarskog hotela s četiri zvjezdice nikada nije uspio podmiriti račun, a udruga preko koje je organizirana utrka morskih bolida odavno više ne postoji.
Vlasnik hotela prethodno je posvjedočio kako je račun prvotno bio naplaćen, no da je odmah napravljen povrat tih sredstava jer je Buljan prijavio krađu i zloporabu njegovih bankovnih kartica.

Županijski sud u Zadru je ukinuo dio presude u kojem se Buljanu nalaže plaćanje duga nakon žalbe državnog odvjetnika
koji je naveo kako sud uz izricanje sankcije nije mogao usvojiti nepostojeći imovinsko pravni zahtjev oštećenika Zdravka Barbaroše jer je on 11. listopada 2017. naveo da odustaje od bilo kakve ideje da se naplati i da ne vidi razlog za vođenje ovog kaznenog postupka.

Buljanov odvjetnik Milan Petričić je također naveo kako nije moguće oduzeti imovinsku korist kaznenim djelom od okrivljenika koji tu korist nije pribavio, već je prema izreci presude pribavljena korist pravnoj osobi koja više radi likvidacije i ne postoji.

Buljan je 22. ožujka 2018. sproveden u Remetinec zbog kazne od 15 mjeseci zatvora na koju je pravomoćno osuđen 2012. zbog prijevare Ante Ljubičića i Michaela Pranjića, dvojice američkih Hrvata koji su preko njega htjeli kupiti tvornicu TVIK d.d. u Kninu. Buljan međutim nije kupio spomenutu tvrtku već je 175 tisuća američkih dolara zadržao za sebe.

Zadarski odvjetnik Davor Buljan (72), bivši vlasnik licencije "Formule 2000", koji je koncem rujna 2003. godine u Zadru organizirao prvu utrku morskih bolida zahvaljujući prijateljstvu s Tuliom Abatteom, svjetskim imenom u proizvodnji superbrzih čamaca, pravomoćno je osuđen za prevaru vlasnika hotela 'President' gdje je ostao dužan 137.914 kuna za banket nakon održanog mitinga.

Čak osamnaest godina od kada je ostao dužan vlasniku zadarskog hotela Zdravku Barbaroši, Županijski sud u Zadru potvrdio je presudu nižeg suda koji ga je za kazneno djelo prevare osudio na uvjetnu kaznu od godine dana s rokom kušnje od tri godine.

Iako je potvrdio kaznu, Županijski sud u Zadru je ukinuo dio presude u kojem se Buljanu nalaže da u roku od šest mjeseci Barbaroši isplati dug od 137.914,50 kuna, ili će se uvjetna osuda opozvati.

Zadarski odvjetnik je te 2003. kao predsjednik udruge moto-nautičkog kluba “Formula 2000” i organizator svjetskog prvenstva u utrci motornih čamaca s Barbarošom dogovorio smještaj natjecatelja i njihovu prehranu. Nakon što je dogovora nije podmirio račun od 137 tisuća kuna koje je trebao podmiriti Visa i American karticama. Vlasnik tada jedinog zadarskog hotela s četiri zvjezdice nikada nije uspio podmiriti račun, a udruga preko koje je organizirana utrka morskih bolida odavno više ne postoji.
Vlasnik hotela prethodno je posvjedočio kako je račun prvotno bio naplaćen, no da je odmah napravljen povrat tih sredstava jer je Buljan prijavio krađu i zloporabu njegovih bankovnih kartica.

Županijski sud u Zadru je ukinuo dio presude u kojem se Buljanu nalaže plaćanje duga nakon žalbe državnog odvjetnika
koji je naveo kako sud uz izricanje sankcije nije mogao usvojiti nepostojeći imovinsko pravni zahtjev oštećenika Zdravka Barbaroše jer je on 11. listopada 2017. naveo da odustaje od bilo kakve ideje da se naplati i da ne vidi razlog za vođenje ovog kaznenog postupka.

Buljanov odvjetnik Milan Petričić je također naveo kako nije moguće oduzeti imovinsku korist kaznenim djelom od okrivljenika koji tu korist nije pribavio, već je prema izreci presude pribavljena korist pravnoj osobi koja više radi likvidacije i ne postoji.

Buljan je 22. ožujka 2018. sproveden u Remetinec zbog kazne od 15 mjeseci zatvora na koju je pravomoćno osuđen 2012. zbog prijevare Ante Ljubičića i Michaela Pranjića, dvojice američkih Hrvata koji su preko njega htjeli kupiti tvornicu TVIK d.d. u Kninu. Buljan međutim nije kupio spomenutu tvrtku već je 175 tisuća američkih dolara zadržao za sebe.

Zadarski odvjetnik Davor Buljan (72), bivši vlasnik licencije "Formule 2000", koji je koncem rujna 2003. godine u Zadru organizirao prvu utrku morskih bolida zahvaljujući prijateljstvu s Tuliom Abatteom, svjetskim imenom u proizvodnji superbrzih čamaca, pravomoćno je osuđen za prevaru vlasnika hotela 'President' gdje je ostao dužan 137.914 kuna za banket nakon održanog mitinga.

Čak osamnaest godina od kada je ostao dužan vlasniku zadarskog hotela Zdravku Barbaroši, Županijski sud u Zadru potvrdio je presudu nižeg suda koji ga je za kazneno djelo prevare osudio na uvjetnu kaznu od godine dana s rokom kušnje od tri godine.

Iako je potvrdio kaznu, Županijski sud u Zadru je ukinuo dio presude u kojem se Buljanu nalaže da u roku od šest mjeseci Barbaroši isplati dug od 137.914,50 kuna, ili će se uvjetna osuda opozvati.

Zadarski odvjetnik je te 2003. kao predsjednik udruge moto-nautičkog kluba “Formula 2000” i organizator svjetskog prvenstva u utrci motornih čamaca s Barbarošom dogovorio smještaj natjecatelja i njihovu prehranu. Nakon što je dogovora nije podmirio račun od 137 tisuća kuna koje je trebao podmiriti Visa i American karticama.
