Na taj način doveden je u pitanje ovršni sustav koji omogućuje Fini, prometnoj policiji i javnim bilježnicama da provode ovrhe mimo sudova, donsoi tportal.com.

Presuda Europskog suda temelji se na slučaju njemačkog državljanina Svena Klausa Tederahna koji je uložio prigovor protiv rješenja o ovrsi kojim mu je pulsko komunalno poduzeće pokušalo naplatiti dug od 13 eura za parking.
Europski sud zauzeo je stajalište da se hrvatski javni bilježnici ne mogu podvesti pod pojam 'suda' pa stoga ne smiju prisilno utjerivati dugove.

Iz Hrvatske javnobilježničke komore proučuju da se posljedice nedavnih presuda koje je Sud Europske unije donio o pitanjima koja se odnose na postupanje javnih bilježnika u postupku ovrhe na temelju vjerodostojne isprave ne odnose na postupke ovrhe između vjerovnika i dužnika u Republici Hrvatskoj.
